A broader bill on protecting minors online, which would have extended age-verification duties to platforms outside the EU that target Spain and made exposing minors to pornography a crime, lapsed when parliament was dissolved on 6 October 2026 ahead of the 29 November general election. Ley 13/2022 (art. 89.1(e)) has required age verification for pornography on video-sharing platforms since 9 July 2022, but only for platforms under Spanish jurisdiction: established in Spain or, for a provider outside the EU, with a parent, subsidiary or group company in Spain (art. 3.3 and 3.4). The CNMC enforces it against Spanish-based adult sites, but it does not reach the major porn sites, which are based elsewhere, so the row is coded no_law. A bill (121/000052) that would have extended the duty to non-EU platforms targeting Spain lapsed when the Cortes were dissolved on 6 October 2026.

Is Pornhub available in Spain?

No Spain-specific restriction or age check has been reported. Pornhub is operated from another EU state, so Ley 13/2022 does not reach it; it is regulated under the EU Digital Services Act, and in March 2026 the European Commission preliminarily found Pornhub in breach of that law for allowing minors to access its service.

  • Proyecto de Ley Orgánica para la protección de las personas menores de edad en los entornos digitales (121/000052). Government bill that would have extended Ley 13/2022's age-verification duties (arts. 88 to 91) to video-sharing platforms established outside the EU that specifically target the Spanish market (a new art. 3.9) and required privacy-protective age verification for the most harmful content; rewritten Penal Code art. 186 to punish anyone who knowingly makes pornography available, by any means, among minors; criminalised sexual deepfakes; and, through parliamentary amendments, restricted under-16s' access to social networks with harmful content. Congress allowed it to proceed in September 2025, and it was at report stage (ponencia) in the Comisión de Justicia, with amendments agreed as late as 29 September 2026. lapsed (caducado) on 6 October 2026, when Real Decreto 806/2026 of 5 October (BOE of 6 October 2026) dissolved the Cortes for the general election of 29 November 2026

  • Ley 13/2022 General de Comunicación Audiovisual (art. 89.1(e)) (effective Jul 9, 2022). Requires video-sharing platforms to establish and operate age-verification systems that in any case stop minors reaching the most harmful content, such as gratuitous violence or pornography (art. 89.1(e)). It applies only to platforms established in Spain or, for a provider outside the EU, with a parent, subsidiary or group company in Spain (art. 3.3 and 3.4). Breach is a very serious infringement (art. 157.8), with fines scaled to Spanish revenue up to €1.5 million (art. 160), imposed by the CNMC, which has fined Spanish-based adult sites under it. It does not reach platforms established in other EU states, where the major porn sites are based.
  • Código Penal, art. 186. Punishes anyone who 'por cualquier medio directo' (by any direct means) sells, distributes or exhibits pornography among minors, with six months to a year in prison or a fine. The government's explanatory memorandum to bill 121/000052 says this wording does not adequately cover making pornography available indiscriminately where minors will see it, which is why the bill would have rewritten it.
  • Digital Services Act (effective Feb 17, 2024). Governs the large porn platforms established in other EU states; the European Commission enforces it against very large platforms.
  • EU age-verification app and Spain's 'Cartera Digital Beta'. Spain is a pilot country for the EU age-verification app and has developed its own age-check wallet app, which is in testing.
